Draconian Nature of POCSO Offences: Madras High Court while pronouncing an acquittal judgment of a school teacher who was convicted under the Prevention of children from sexual offenses Act and sentenced to 5 years jail term, passed by Dharmapuri Mahila Court, dated 30th October 2018 on the contradicting allegation of sexually assaulting his girl students.
The court while taking concern about the case observed that the court should be extra cautious while dealing with such case because of its “Draconian nature” Justice R.N Manjula said that the offenses that come under the prevention of Children sexual offences Act must be treated seriously the said court should also be cautious to while pronouncing a conviction because the offender has a huge social responsibility for proving his innocence, the punishment is excess and serious
